2. Service Description

Skardu provides automated demo reminder services through email, SMS, and voice calls. The Service:

  • Automatically detects scheduled demos from connected calendar services
  • Sends automated reminder messages based on your configured templates and timing
  • Provides analytics and tracking for sent communications
  • Integrates with third-party services (Calendly, SMTP email providers, Twilio, etc.)

Service Limitations: Skardu does not guarantee:

  • 100% email deliverability or SMS/voice call completion
  • Specific reduction in no-show rates
  • Uninterrupted service availability
  • Compatibility with all email providers or systems

3. User Compliance & Legal Responsibilities (CRITICAL)

Users are solely responsible for ensuring that their communications comply with all applicable laws, including but not limited to:

Skardu provides automation tools only and does not control or initiate communications. You acknowledge and agree that:

  • You have obtained all necessary consents from recipients before sending any communications
  • You will maintain records of consent as required by law
  • You will honor all opt-out and unsubscribe requests promptly
  • You will not use the Service to send spam, unsolicited messages, or unauthorized communications
  • You are responsible for the content, accuracy, and legality of all messages sent
  • You will include required disclosures and unsubscribe mechanisms in your messages

4. Account Terms

When you create an account with us, you must:

  • Provide accurate, complete, and current information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access or security breaches
  • Accept responsibility for all activities that occur under your account
  • Not share your account with others or create multiple accounts

You are responsible for safeguarding API keys, OAuth tokens, and any other credentials associated with your account and connected integrations.

5. Integration & Third-Party Services

The Service integrates with various third-party platforms including but not limited to:

  • Calendar services (Calendly)
  • Email services (SMTP providers)
  • Communication services (Twilio for SMS and voice)

You acknowledge that:

  • You are responsible for maintaining active accounts with these third-party services
  • Skardu is not liable for any failures, changes, or issues with third-party services
  • You must comply with the terms of service of all integrated third-party platforms
  • You grant Skardu necessary permissions to access these services on your behalf
  • Third-party services may have their own costs which are separate from Skardu fees

6. Data Usage & Privacy

Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points include:

  • We process data solely to provide the Service
  • We do not sell or rent your personal data to third parties
  • We implement industry-standard security measures
  • You retain ownership of your data and content
  • We may retain certain data as required by law or for legitimate business purposes

7. Acceptable Use Policy

You agree not to use the Service to:

  • Send spam, bulk unsolicited messages, or deceptive communications
  • Harass, threaten, or harm others
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or malicious code
  • Attempt to gain unauthorized access to our systems
  • Engage in any activity that disrupts or interferes with the Service
  • Exceed reasonable usage limits or abuse the Service
  • Resell or redistribute the Service without authorization

We reserve the right to suspend or terminate accounts that violate this policy without notice.

8. Payment Terms

Free Trial

  • All new users receive a 14-day free trial with full access to all features
  • No credit card required during the trial period
  • You can test all functionalities and integrations during the trial
  • Trial automatically expires after 14 days unless you upgrade to a paid plan

Lifetime Deals (LTD)

  • Access continues as long as the Service operates
  • Features included are those specified at time of purchase
  • No guarantee of future features unless explicitly stated

Subscriptions

  • Subscription fees are billed in advance on a recurring basis
  • You authorize automatic charges to your payment method
  • Price changes will be notified 30 days in advance
  • Non-payment may result in service suspension

Your Content: You retain all rights to your content (templates, messages, data). By using the Service, you grant us a limited license to process and transmit your content solely to provide the Service.

Feedback: Any feedback, suggestions, or ideas you provide may be used by us without obligation or compensation to you.

10. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, secure, or error-free
  • Results obtained will be accurate or reliable
  • Any specific reduction in no-show rates will be achieved

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

11. Indemnification

You agree to defend, indemnify, and hold harmless Skardu, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your violation of any third-party rights
  • Any content you submit or transmit through the Service
  • Claims related to unauthorized communications sent using the Service

12. Termination

By You: You may terminate your account at any time through the account settings or by contacting support. If you terminate within 14 days of purchase, you may request a refund under our money-back guarantee.

By Us: We may suspend or terminate your account immediately for:

  • Violation of these Terms or Acceptable Use Policy
  • Legal compliance reasons
  • Extended periods of inactivity

Email Services

  • Email deliverability depends on multiple factors beyond our control
  • Spam filters, blocklists, and recipient settings may affect delivery
  • We do not guarantee inbox placement

SMS/Voice Services

  • SMS and voice services are provided through your Twilio account
  • You are responsible for Twilio costs and compliance
  • Carrier filtering and blocking may affect delivery
  • International messaging subject to additional restrictions

Calendar Synchronization

  • Calendar sync accuracy depends on third-party APIs
  • Delays in synchronization may occur
  • Private or restricted events may not be accessible

Template Variables

  • Accuracy of merge variables depends on data quality from integrated services
  • Missing or incorrect data may result in incomplete messages
  • You are responsible for testing and verifying template output
